On June 2005, Elder Advocates Of Alberta Society commmenced legalproceedingsagainst the government & nine Health Regions.This legal class action lawsuit must be certified as a class action lawsuit.
Application for certification will be be heard during the last week of January2008 at theLaw Courtsin Edmonton, AB. Madame Justice Sheila Grekolpresiding.The Hearing is scheduled for five days.January 28 – 31 &February 1, 2008. The matter was heard for three days inSeptember, 2007.
The claim relates to the accommodation rate increase that took effectAugust 1, 2003 which over the past two years amounts to one hundred &twenty eight million, seven hundred thousand dollars ($128, 700, 000) forthe 13,437 Alberta residents affected.The essence of the claim is that while there was a 40% increase in long termcare fees charged to nursing home residents, the Defendants reduced healthcare funding for nursing homes.In the Governments Press Release of June 17, 2003, it was claimed that theaccommodation rate increase would “improve the quality of resident careservices”.It is a matter of public record that this did not happen.The Statement of Claim alleges that by raising the accommodation chargeandfailing to adequately fund health care, the Defendants acted in bad faithand withcareless disregard for the interests of the class members.
The accusations contained in the Statement of Claim reflect a massivedeceptionthat was perpetrated against the seniors of Alberta.
